A year ago, greylisting by the Financial Action Task Force (FATF) cast a shadow over South Africa's financial landscape. This designation, which represents deficiencies in a country's regulatory regime in the fight against money laundering, proliferated financing and terrorist financing, has raised concerns about economic consequences and global competitiveness.

In this podcast, Gabi Richards-Smith, Lerato Lamola, Kirsten Wolmarans, and Rashaad Carrim delve into the complex journey of removing South Africa from greylisting.

This insightful discussion tackles the remaining hurdles and emphasises the collective effort needed for delisting. While challenges persist, cautious optimism prevails for a 2025 delisting and a more robust anti-money laundering system in South Africa.
In this podcast, Cor Kraamwinkel, Candice Meyer and Margaret Vermaak highlight how ESG extends its impact from global sustainability goals to individual companies and individuals in South Africa.

They explore three areas where ESG considerations influence taxation: transparency and disclosure, ethical tax contributions, and the tax treatment of ESG expenditure. They also emphasise that there is no dedicated section in the Income Tax Act for ESG; instead, general principles and case-specific analysis apply to determine the deductibility of such expenses.

Tax insights on debt and corporate restructurings for businesses in distress

Given the current economic crisis as a consequence of the Covid 19 pandemic, as well as the state of the South African economy over the last few years, we have seen a significant increase in debt and corporate restructurings by South African corporate entities. It's no surprise that this trend has continued throughout the last few months, and will most likely continue for the foreseeable future.

Unfortunately, given the complexity of the tax rules relating to debt and corporate restructurings, if these restructurings are not implemented correctly, this could result in additional taxes being payable as well. Obviously, this is not first prize for any entity that finds itself in this situation.

In this podcast, Brian Dennehy and Kyle Beilings process the complicated minefield of debt and corporate restructurings for businesses in distress. They cover the types of debt restructuring mechanisms that are available to companies, tax liabilities and more.

This is Webber Wentzel Legal Insights with your host, Dario Milo.

This is episode 5 of our series on Media Law and we are looking at a very important recent defamation case where two veteran journalists, represented by Webber Wentzel, successfully sued the Economic Freedom Party for being called Stratcom agents. Dario's guests are the two applicants in that case - celebrated journalist, author and Economics Editor at SABC NEWS Thandeka Gqubule-Mbeki, and the Caxton Professor of Journalism at Wits University Anton Harber. Anton is the founder and former Editor of the Mail & Guardian and the former Editor-in-Chief of eNCA. Anton and Thandeka go back 30 years to explain the background to this fascinating defamation case and then discuss the judgment itself. It is a deep dive behind the scenes of a stunning legal case.

This is Webber Wentzel Legal Insights with your host Dario Milo. In this episode we continue our series on Media Law by looking at Surveillance. This is the third episode in the series of 5.

Surveillance by the government and others of journalists has become a major concern around the world, and increasingly in South Africa. amaBhungane's challenge to aspects of the surveillance laws - seeking to compel greater checks and balances - is pending before the Constitutional Court. Unjustified surveillance undermines our privacy rights, and also impacts on freedom of expression and media freedom.

Dario's guests are Sam Sole and Jane Duncan. Sam, award-winning investigative journalist and amaBhungane co-managing partner, fortuitously discovered he was under surveillance and with his colleagues at amaBhunagne decided to challenge the law. Professor Jane Duncan is in the Department of Journalism, Film and Television, at the University of Johannesburg and is the author of the book “Stopping the Spies: Constructing and resisting the surveillance state in South Africa”.

Media Law: Disinformation - Episode 2

Welcome to Webber Wentzel Legal Insights. With over 150 years of experience and deep industry knowledge, Webber Wentzel is the leading full-service law firm on the African continent.

In this series, your host Dario Milo unpacks media law in an exciting and informative way. In this episode he explores the problem of disinformation (false or misleading information that is spread deliberately to deceive). Although this episode is not focused on Covid-19, and was recorded before the "false news" crime now enacted in the Lockdown Regulations – the topic is particularly timely given the extent of disinformation that we have seen related to the pandemic.

Dario is joined on this episode by William Bird, Director of Media Monitoring Africa, an organisation that monitors the media and implements successful media strategies for change. Together they will tackle topics such as using defamation law to address disinformation, Media Monitoring Group's Real 411 initiative to address digital disinformation, and whether there should be tighter legal regulation of disinformation.

Webber Wentzel has recently launched Webber Wentzel Legal Insights. The first series on the channel relates to the effect of the Covid-19 outbreak on various sectors, starting with mining – a priority sector to the South African economy. This series recorded last week gathers insights from several Webber Wentzel experts who seek to unpack issues related to regulations, workforce issues, contracts, disputes and tax. The discussion relates to what has happened (and how to manage the issues that emerge), but is also forward looking – taking a glance into what lies ahead after the lockdown ends.
Webber Wentzel’s legal experts from this episode: Lizle Louw, Nirvasha Singh, Garyn Rapson, Kate Collier, Merlita Kennedy and Rita Spalding.
Executive Producer: Paula Youens.
